TERMS & CONDITIONS

Our website is owned and operated by HAVESOME Ltd, a company incorporated in England & Wales with registered number 08425492 and whose registered address is 207 Regent Street, London W1B 3HH (havesome.com and havesome.co.uk). This is the user agreement that governs your use of this website and the provision of the services we provide you. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms and Conditions (the “T&C”) at any time without further notice. We will post any changes to the T&C on this page and will indicate at the top of this page the date when the last change was made. Your continued use of the website after any such changes constitutes your acceptance of the new T&C. It is your responsibility to regularly check the website to determine if the T&C have changed and to review such changes. Please read the T&C carefully and ensure that you fully understand our contractual relationship both relating to your use of our website and the services we provide you. Importantly, the T&C also govern our relationship subsequent to order placement, which is why it is imperative that you fully understand what your rights and obligations are before you place an order with us. You will be asked to check a box that states you have agreed to our T&C on the checkout page. Prevailing laws for settling any disputes will be based on the location of our company corporate headquarters, which is England.

Description of Products

All products available for purchase are described on their specific product page on our website. We always try to represent as accurately as possible the characteristics of the products via pictures and text, some of which have been provided directly by designers, suppliers and/or manufacturers. We strive to provide you with the best available images and description, but unfortunately cannot guarantee that colours and details on the website are always 100% accurate representations of the product you will receive. The manufacturing process of most of our products includes stages which are completed by hand. This ensures the high quality of our products, but may also cause the actual product dimensions to differ slightly from those published, which is why sizes are normally approximate.

Even if not always mentioned, some self-assembly may be required on certain products.

We strive to continuously improve our offering and reserve the right to amend the specifications of products, their price, size, packaging and any service associated at any time, without prior notice. Even if you have visited the product page in the past, before ordering you should have another close look at the product description and characteristics and make sure it is what you desire.

Prices

All prices are based on pounds sterling (£), but we may provide clients the opportunity to purchase items in other currencies, including EUR and USD. Prices are payable in the currency indicated on the checkout page, plus any applicable taxes, as indicated on the check out page.

Product prices do not include any delivery costs, unless specifically stated otherwise. Delivery costs are indicated separately on the product page and / or on the checkout page and are presented to you before you make your final payment. Please note that we reserve the right to change prices at any time without notice.

For certain products we may indicate comparable prices, which refer to market prices of products, which we consider to be comparable to a certain extent. We do not represent or guarantee that these are the best comparable market prices for such products and provide them only as an example. Such prices are only indicative, are determined outside of our control and thus may change at any time without notice and without our knowledge. Any comparable products may have different characteristics, including quality of raw materials used, attention paid to the finishing of the products, retailing location and other characteristics.

The total price payable for the goods and services will be stated at the time when you place your order. If the price published for the goods is wrong due to an error or omission, HaveSome is not obliged to sell the product at the incorrect price. Instead, we will inform you of the correct price and give you the opportunity to cancel the order. If you decide to cancel the order and payment has been made, we shall refund you the full payment made by you.

Should the price change or be incorrect, our contractual agreement is void and must be restarted by you, the customer.

Promotional Sales

From time to time we may offer promotional sale prices on some products for a specific sale period, which is clearly notified on the product page. Nonetheless, we may promote the most popular ones for an extended period of time.

Before Placing an Order

In order to avoid unnecessary and quite unpleasant consequences, before placing your order you must check and confirm your full ability to receive the products. This includes ensuring that the product can pass freely into your building, stairs/lift, doorways and into the room of your choice, and that the assembled product will fit in that room the way you intend it to (length, height, width). You should identify any other issues that could make the delivery or intended use complicated or impossible .

Please also carefully read to product description details on the product page and these T&C in their entirety before placing an order.

Placing an Order

In order to ensure successful delivery of your item, it is absolutely necessary that you provide the accurate delivery address as well as an up-to-date mobile telephone number and e-mail address, which you will check prior to, and on the delivery day.

Your order represents an offer to us to purchase a product which is accepted by us when we send an email confirmation to you that we have dispatched that product to you. That acceptance will be complete at the time we send the dispatch confirmation email to you. Any products on the same order, which we have not confirmed in a dispatch confirmation email to have been dispatched, do not form part of that contract.

The company shall under no circumstances be held liable for any losses special to the particular circumstances of the customer, indirect or consequential losses or for loss of profits, damage or property or wasted expenditure.

Payment

We accept [all major credit and debit cards including American Express Visa/Visa Electron, MasterCard and Switch/Maestro]. When ordering you must provide us with your exact billing address and telephone number, exactly in the way that your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.

Your debit or credit card is charged for the whole amount of the order when the order is created, either through our website or over the phone.

The sale will be submitted for processing as soon as you click on the “confirm” button. You will then receive an email from us to confirm the sale, availability of the product, and expected delivery date.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing or by reason of unwinding or suspending any transaction after processing has begun.

The value of an order can be refunded to the card if the items in the order are cancelled at any time up until when we dispatch the items to you. If the entire order is cancelled and no items are dispatched, then any charge for handling and/or delivery will also be refunded.

The contract between HAVESOME Ltd and you as the Customer shall come into existence at the time and date when you accept our General Terms and Conditions (“T&C”) and bindingly confirm an order on our website or over the phone. You as the Customer hereby recognize the logged content of our website as a means of evidence. You shall receive an email containing your order as a confirmation if correct information has been provided.

Title in the goods held in stock by the company transfers to the customer once payment has been received in full. Until the full payment of the purchase price, the goods shall remain the property of HAVESOME Ltd.

The goods will be delivered as per our communication to you.

Credit and Debit Card Payments

Credit and Debit Card payments are handled by [Processing Company Name].

We use one of the most powerful security systems on the Internet, a Secure Socket Layer (SSL) reinforced by an encryption process in order to protect all significant data related to payment.

Product Availability

If an order is delayed or is unable to be placed to the factory for any reason (lack of interest and of orders for the product, manufacturing process trouble, quality control issue, or other quality or manufacturing issues), we would do our best to notify you as soon as possible. Should our selected manufacturer decide they are unable to produce a specific product matching our quality standards, we would remove it as fast as possible from our website. Should you have placed an order for that specific product, you would be notified by email of the situation, your order would be cancelled and you would be reimbursed in full.

Delivery & Order Execution

Our mission is quite simply to provide you items with outstanding value, based on a carefully selected combination of visual appeal, quality and price. In order to achieve that, we execute a flexible supply system, which means that some products may take several weeks to reach you. If you have done any shopping around, you are probably already aware that waiting periods similar to ours are relatively common in retail, end especially the furniture industry. What is not common is our outstanding product selection and value. We don’t like the wait ourselves, but in our view the result is what really matters, given that we hope you will enjoy the products for years to come.

Some of the products we sell may be available in stock, in which case we will dispatch them to you as soon as possible. In other cases, no items may be available in stock, in which case we will place an order to the manufacturer / supplier to produce the items especially for you. In certain cases, we may accumulate several orders before communicating them to the manufacturer / supplier, which may be required in order to get you the best possible prices stated on our website. In such cases, we may indicate on the product page when the accumulated order will be communicated to the manufacturer/supplier. In any case, on the product page we always clearly state the estimated delivery period from the time you place your order until the day of delivery.

We strive to always give you the most accurate expected delivery period and to deliver the goods within that period. However, any dates we specify for the delivery of the goods are approximate only and may change for reasons outside of our control. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.

Should there be any significant changes to the expected delivery period after you place an order, we aim to notify you as soon as possible.

Deliveries shall only be made maximally to the entrance door of the building.

Saturday delivery or collections may be available at an extra charge.

Delivery Providers

We reserve the right to use the delivery company, which is most suitable for your order, at our sole discretion. Most often we use DPD, which is one of the most widely used delivery companies in the UK, but we may use another high quality delivery provider as well. 

Delivery Charges

Delivery / postage charges are paid by the client, unless expressly stated otherwise. The delivery charges are clearly stated on the product page and / or in the checkout page.

Delivery Destinations

We have optimized our delivery system in UK Mainland, and our lowest delivery rates are to UK Mainland. The indicated delivery prices and shipping charges shall not apply to any orders with delivery addresses at remote locations. For such orders, please contact us at support@havesome.co.uk about our conditions of shipment or delivery. We do process deliveries to other parts of the UK, the EU and the US, at higher delivery rates.

Please contact us for a specific quote and we will aim to provide you with rates that take advantage of our contacts and relationships with delivery companies.

Split Delivery     

Where possible we will deliver all items in your order at the same time. However, sometimes we will split the delivery of your order as we may receive items from different suppliers at different times. So, first of all, check your delivery note or dispatch emails to see if any of your items will be arriving separately. If the delivery note says an item should be in your parcel but it isn’t, please contact us at support@havesome.co.uk. Let us know the Order Number and Product Code/Name of the missing item, and we’ll look into it. There is no additional charge to you if the order is split.

Product Assembly, Installation, Use and Care

It is imperative that you exactly follow the product assembly, installation, use and care instructions that we provide you with. Should you not be able to locate them for any reason, please contact us via email and we will aim to provide you with a copy. In addition to exactly following the said instructions, you should always use care and common sense in the assembly, installation and use of, as well as care for the products, to avoid any unnecessary issues.  

With the exception of our clothing / apparel products, and unless expressly stated otherwise, our products are intended for use in an indoor domestic private residential setting only and we provide no guarantees for their suitability outside of this. In particular we do not provide any guarantees if they are used in a commercial, public or contract environment.

With the exception of our clothing / apparel products, our products carry a first year manufacturer's guarantee. However, this does not cover accidental damage or misuse of the item, including use outside of their intended use.

Order Cancellations and Returns

We want you to be happy with your purchase. However, we know that from time to time people want to return items. Should you decide to do so, all we ask of you is to follow our Returns Policies and Procedures (“RPPs”). We will not be able to process a return if our RPPs have not been complied with.

Important details and deadlines of our RPP:

Before an item is dispatched to you

Up until an item is dispatched to you, you can cancel an order for a full refund of the value of the items you ordered. If the entire order is cancelled and no items are dispatched then any charge for handling and/or delivery will also be refunded.

Upon signing for / accepting delivery

-        Should you notice an obvious damage to the packaging of the item, please write “Damaged” next to your signature when you accept delivery of the item.

-        It is imperative that you also ask the driver to sign next to the word “Damaged” as a confirmation that the packaging is damaged.       

No later than 24 hrs after delivery

-        If you identify any damaged or faulty items or components, you need to notify us in writing (at support@havesome.co.uk).

-        Please attach to your email at least 2 (two) pictures of the damage, so that we can advise you of the most appropriate action.

No later than 7 working days after delivery

-        Should you decide that you would like a return, exchange or replacement, please notify us in writing (at support@havesome.co.uk)

-        In the email, please indicate whether you would prefer 1) refund of the purchase price, 2) exchange with a different item, or 3) replacement with the same or a similar item

-        Please note that we do not refund any postage / delivery cost that have been paid for the original delivery of items

-        Please note that we do not offer free returns or collection service. People who decide to return items would be responsible for the postage / delivery charges for returning the item

-        Please refer to the Reselable Condition section for further comments on the acceptable condition of returned items

No later than 10 calendar days after delivery

-        Post the item back to us no later than 10 (ten) calendar days after the item was delivered to you

How do I return an item?

If something is not right and you would like to return a product, please follow our Return Policies and Procedures (“RPP”). Under the Distance Selling Regulations, if you buy online or by phone, your consumer rights entitle you to a full refund if you request one in writing within 7 working days of receipt, as long as the item is returned in fully reselable condition

To return items, please follow the steps below, which form part of our RPP:

1.      Please email us at support@havesome.co.uk within 7 (seven) days of delivery for non-faulty items and within 24 hours for faulty items

2.      In your email include a detailed description of the reason for return and your preferred next step (monetary refund, replacement with a different product, or an exchange with the same or a similar product

3.      For faulty items, please attach to your email at least 2 (two) pictures of the damage

4.      Use the original packaging to repack your returns, ensuring that the product is packed well enough to avoid any damage during transport back to our warehouse. The product must arrive at our warehouse in a resaleable condition

5.      Please address the return package to our address for returns, which is: 55 Friars Avenue, London N20 0XG, UK

6.      Reseal the parcel and take it to the Post Office or a courier company within 10 (ten) calendar days of receipt

7.      When returning your purchase by mail we recommend that you get proof of postage. This is your proof if your parcel goes astray. We recommend you also use recorded delivery or similar, thereby obtaining a unique tracking ID

8.      Obtain shipping insurance to cover for any accidental damage during transportation back to us

Once we have inspected the product and have confirmed that it is in reselable condition and there is full compliance with our Return Policies and Procedures, we will process a refund to the card you used to purchase your goods.

We cannot process a return if our RPP have not been complied with.

We do not offer free returns and collection service. We do not refund any postage/delivery cost, either for the initial delivery of the item to you, or for any subsequent returns that you may decide to make to us.

Damaged or Faulty Goods

If your purchase is faulty or damaged, please notify us in writing within 24 hours of delivery of the item to your address. Please email us at support@havesome.co.uk. And attach at least 2 (two) pictures of the damage.

The customer can only get a repair, exchange (new delivery) or a financial compensation up to the value of the goods. HAVESOME Ltd reserves the right to make the final decision of whether to repair, exchange or to provide financial compensation to the customer for damaged or faulty goods.

What is Reselable Condition?

We retain the right to refuse a refund on any item not deemed to be in a resalable condition. Reselable condition includes all of the following:

-        Items must not have been used, modified or repaired in any way;

-        Items must not have been partially or fully assembled. We cannot accept items which you had started to assemble, so please carefully check all parts before assembly;

-        There must not be any missing parts;

-        Items must be in the original, unmarked and undamaged packaging. We cannot accept items whose packaging is in any way damaged, so please take care when unpacking items;

-        Items must include all original, unmarked and undamaged documentation, which came with these items, including, but not limited to, item description and assembly instructions (where applicable);

-        Items must be in any other way in a reselable condition

Product Warranty

The goods we sell are for consumers for general domestic use only and must be used for the intended purpose. All products supplied are covered by the terms and conditions of the Manufacturers Guarantee for a period of 12 months. This is in addition to your statutory rights as a consumer under the Sale of Goods Act relating to faulty or misdescribed goods.

The guarantee does not cover the following: any damage resulting from normal use (wear and tear), ageing, temperature or weather conditions, improper handling, including damage caused by the buyer or loss of parts or accessories.

The warranty shall expire if the goods have been processed or altered in any way despite recognisable defects.

Any complaints shall be made within 24 hours after the receipt of the goods. Any defects emerging at a later date, i.e. during the warranty period, shall be reported immediately after their discovery. To claim the warranty the buyer is obligated to show the sales document. You may return any unused goods within 10 calendar days of delivery.

Defects shall be rectified by HaveSome Ltd or if authorized by HaveSome Ltd by a local craftsman, unless HaveSome Ltd prefers to provide faultless goods by way of replacement. Any further claims shall be excluded.

Under warranty, the customer has to return at own expense the goods within 10 calendar days after discovery of the defect to the warehouse address specified by HAVESOME Ltd.

All services (payment fees, express delivery, installation, etc.) are excluded from any refund.

For defects that are not covered by the warranty of the seller, the buyer will receive a suitable offer.

Complaints

Should you have any complaints or comments, we would appreciate it if you could notify us in writing at support@havesome.co.uk. We appreciate constructive criticism and strive to learn from it and improve

Liability

We shall not be liable for any damage that we could not have influenced ourselves. For any damage which results from the purchase, shipment or use of the products and which we could have prevented, we shall be liable up to the purchase amount of the product. The maximum amount of loss shall be limited to GBP 2,000 in any case.

Use of our Website, Trademarks and Copyright

All content included on the website, such as pictures, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of HAVESOME Ltd. and is protected by United Kingdom and international copyright and database right laws. The compilation of all content on this website is the exclusive property of HAVESOME Ltd. and is protected by United Kingdom and international copyright and database right laws. All software used on this website is the property of HAVESOME Ltd. and is protected by United Kingdom and international copyright laws.

You may not systematically extract and/or re-utilise parts of the contents of the website without HAVESOME's express written consent.
